1. Acceptance of Terms

By downloading, installing, or using Forager's Field Notes ("Forager's Field Notes," "the App"), provided by Adelyons Software LLC ("we," "us," or "our"), you agree to these Terms of Service and End User License Agreement (the "Terms") and to our Privacy Policy. A standalone End User License Agreement is also available and is incorporated by reference. If you do not agree, do not use the App.

2. Foraging Safety — Please Read

Forager's Field Notes is a journal and learning tool, not an identification tool. The App does not identify any plant, mushroom, or other organism, and it does not assert, confirm, or imply that anything is edible, safe to eat, or safe to handle. You are always the identifier, and you alone are responsible for what you choose to gather, handle, or consume.

No identification, ever: The App is a private field journal, an offline patch map, an educational lookalike field guide, and a deterministic intelligence layer over your own logged history. It never names a species for you and never renders a verdict on edibility. Any common name, category, or note attached to a find is information you entered.
Confirm, don't identify: The in-app safety checklist and lookalike cards exist to help you rule a find out and to confront its dangerous lookalikes. A find you mark "self-confirmed" reflects a decision you made — it is never the App's conclusion that the find is safe.
Deadly risk — assume it: Many wild plants and mushrooms have toxic or deadly lookalikes, and misidentification can cause serious injury or death. Never eat, handle, or rely on a wild find based on this App. Confirm every find with a qualified local expert and authoritative references. When in doubt, throw it out.
You assume all risk: You assume all risk arising from foraging, gathering, handling, preparing, or consuming any wild organism. To the maximum extent permitted by law, Adelyons Software LLC is not responsible or liable for any illness, injury, allergic reaction, poisoning, death, property damage, trespass, or other loss arising from your foraging activity or your use of the App.
Forage lawfully: You are responsible for knowing and following all laws, regulations, land-access rules, and permissions that apply to foraging where you are, including on public and private land.

3. License Grant

Subject to these Terms, Adelyons Software LLC grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on a device that you own or control, solely for your personal, non-commercial use. This license does not transfer any ownership rights. All rights not expressly granted are reserved. See the standalone EULA for the full license terms.

4. The Service

Forager's Field Notes is a local-first, no-account foraging field journal. It provides a fast find log, secret "patches" with on-demand GPS pins on an offline schematic map, a confirm-don't-identify safety checklist with lookalike confrontation cards, an offline lookalike field guide, and a deterministic intelligence layer (seasonality forecasts, patch-return reminders, and a foraging-year recap) computed from your own logged finds. As described in our Privacy Policy, your data is stored only on your device; there is no account and no cloud backend. All insights are deterministic, on-device, rule-based logic — there is no language model, no AI model download, and no network or key involved. The App does not identify species and does not assert edibility.

5. Subscriptions & Billing (Forager's Field Notes+)

Free & Forager's Field Notes+: The App's core — the fast find journal, generous patches and pins, the offline patch map, and the entire safety layer (the confirm-don't-identify gate, the lookalike field guide, and the always-visible disclaimer) — is free, and no payment card is required to start. Forager's Field Notes+ unlocks the deterministic intelligence layer and bulk offline-map caching. Plans currently include: a Monthly subscription at $3.99/month; an Annual subscription at $19.99/year (recommended, with a 7-day free trial); and a one-time Lifetime purchase at $39.99. All three unlock the same Forager's Field Notes+ features. Prices may vary by region and are shown in the App at the time of purchase.
Store-managed billing: Subscriptions and the lifetime purchase are billed through your Apple App Store or Google Play account, using their in-app billing, and are managed through that account. We never see or store your payment-card details.
The safety layer is never paywalled: The confirm-don't-identify checklist, the lookalike field guide, and the safety disclaimer are free for everyone and are not part of Forager's Field Notes+. Safety is never an upsell.
Free trial: A clearly-disclosed 7-day free trial is offered on the Annual plan only, and is cancel-anytime. Unless you cancel before the trial ends, the Annual subscription begins and is charged at the then-current price. The Monthly plan and Lifetime purchase do not include a trial.
Auto-renewal: The Monthly and Annual subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. The Lifetime option is a one-time, non-renewing purchase.
Cancellation: You can manage or cancel a subscription at any time in your device's subscription settings (Apple App Store or Google Play). Cancellation takes effect at the end of the current billing period.
Refunds: Refund requests are handled by Apple or Google according to their respective policies.
Changes: We may change pricing or the features included in Forager's Field Notes+ with notice; changes apply at your next renewal.

6. Your Content & Data

You own the information you enter into the App — your finds, common names and notes, patches, GPS pins, photos, and the history they form. Because Forager's Field Notes is local-first, this content is stored only on your device; we do not receive, store, or claim any license to it. You are responsible for keeping your own copies of any exports you create and for the accuracy of what you record. See the Privacy Policy for full details.

7. Acceptable Use

You agree not to:

Reverse-engineer, decompile, or tamper with the App, except to the extent permitted by law;
Use the App in any unlawful way, to forage where you lack permission or a required permit, or to infringe the rights of others;
Circumvent, disable, or interfere with the App's purchase or licensing mechanisms;
Rely on the App to identify a species or to decide that anything is safe to eat, handle, or consume.

8. Intellectual Property

The App, its design, content, and software are owned by Adelyons Software LLC and are protected by intellectual property laws. These Terms grant you a personal, non-transferable, revocable license to use the App; they do not transfer any ownership rights.

9. Apple App Store — Additional Terms

If you download the App from the Apple App Store, the following additional terms apply, and you acknowledge and agree that:

These Terms are between you and Adelyons Software LLC only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
The license granted is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. To the extent these Terms conflict with Apple's standard Licensed Application End User License Agreement (EULA), the Apple Licensed Application EULA governs for App Store downloads.
Apple has no obligation to provide maintenance or support for the App. Any questions or support requests should be directed to us at dev@adelyons.com.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability, regulatory, or intellectual-property claims.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Disclaimers & No Warranty

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any checklist, lookalike card, seasonality forecast, patch-return reminder, recap, map position, or other output will be accurate, complete, or suitable for any purpose. The App does not identify species and does not determine that anything is safe to eat or handle; every such judgment is yours alone. All insights are convenience aids based on the data you enter and on deterministic rules — not professional, botanical, mycological, or medical advice.

11. Limitation of Liability

To the maximum extent permitted by law, Adelyons Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any illness, injury, poisoning, death, loss of data, or loss of profits, arising from or related to your foraging activity or your use of (or inability to use) the App, even if advised of the possibility of such damages. Our total liability for any claim related to the App shall not exceed the amount you paid us for the App in the twelve months preceding the claim.

12. Termination

You may stop using the App at any time by deleting it from your device, which also removes the data stored locally. We may suspend or terminate this license if you violate these Terms. These Terms continue to apply to your prior use.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Effective date" above and, where appropriate, through an in-app notice. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Iowa, United States, without regard to its conflict-of-law principles. You agree that any dispute not subject to the rules of the applicable app store will be resolved in the state or federal courts located in Iowa, to the extent permitted by law.
