1. Agreement

This End User License Agreement (the "EULA") is a legal agreement between you and Adelyons Software LLC ("we," "us," or "our") for the use of the Forager's Field Notes mobile application and any updates, documentation, and associated materials (collectively, "Forager's Field Notes" or "the App"). By downloading, installing, or using the App, you agree to be bound by this EULA, by our Terms of Service, and by our Privacy Policy. If you do not agree, do not download, install, or use the App.

2. License Grant

Subject to your compliance with this EULA, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App in object-code form on a device that you own or control, solely for your personal, non-commercial use. Where the App is obtained through an app store, this license is further governed by the applicable store's usage rules.

3. Restrictions

You agree that you will not, and will not permit anyone else to:

• Copy, modify, adapt, translate, or create derivative works of the App, except as permitted by law;
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent this restriction is prohibited by applicable law;
• Rent, lease, lend, sell, redistribute, sublicense, or otherwise transfer the App or your license to it;
• Remove, alter, or obscure any proprietary notices on or in the App;
• Circumvent, disable, or interfere with the App's purchase, licensing, or entitlement mechanisms;
• Use the App in any unlawful manner, for any unlawful purpose, or in a way that infringes the rights of others.

4. Ownership & Intellectual Property

The App is licensed, not sold. We and our licensors retain all right, title, and interest in and to the App, including all copyrights, trademarks, trade secrets, and other intellectual property rights in its design, code, and content. All rights not expressly granted to you in this EULA are reserved by us. You own the content and information you enter into the App — your finds, common names and notes, patches, GPS pins, and photos — which, because the App is local-first, is stored only on your device; we do not receive, store, or claim any license to it.

5. Subscriptions & Billing (Summary)

The App's core — the fast find journal, generous patches and pins, the offline patch map, and the entire safety layer — is free, and no payment card is required to start. Forager's Field Notes+ is an optional upgrade that unlocks the deterministic intelligence layer and bulk offline-map caching, offered as a Monthly subscription ($3.99/month), an Annual subscription ($19.99/year, with a 7-day free trial), or a one-time Lifetime purchase ($39.99); all three unlock the same features. Subscriptions auto-renew until cancelled; the lifetime purchase is one-time and non-renewing; and the confirm-don't-identify checklist, the lookalike field guide, and the safety disclaimer are free for everyone and are never paywalled. Billing is store-managed through your Apple App Store or Google Play account, and you can cancel anytime in your device's subscription settings. 7. Apple Licensed Application End User License Agreement

If you download the App from the Apple App Store, this EULA is the "Licensed Application End User License Agreement" with respect to the App, and you acknowledge and agree that:

• This EULA is concluded between you and Adelyons Software LLC only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.
• The license granted is a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with the purchaser via Family Sharing or volume purchasing. To the extent this EULA conflicts with Apple's standard Licensed Application End User License Agreement, the terms of Apple's standard Licensed Application EULA govern for App Store downloads.
• Apple has no obligation to furnish any maintenance or support services for the App. Any maintenance, support, or warranty questions should be directed to us at dev@adelyons.com.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product-liability claims, any claim that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection, privacy, or similar legislation.
• In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

8. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted or error-free, or that any checklist, lookalike card, seasonality forecast, patch-return reminder, recap, map position, or other output will be accurate, complete, or suitable for any purpose. The App does not identify species and does not determine that anything is safe to eat or handle. All insights are convenience aids based on the data you enter.

9. Limitation of Liability

To the maximum extent permitted by law, Adelyons Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any illness, injury, poisoning, death, loss of data, or loss of profits, arising from or related to your foraging activity or your use of (or inability to use) the App, even if advised of the possibility of such damages. Our total liability for any claim related to the App shall not exceed the amount you paid us for the App in the twelve months preceding the claim.

10. Termination

This EULA is effective until terminated. Your rights under this EULA terminate automatically, without notice, if you fail to comply with any of its terms. You may terminate this EULA at any time by deleting the App from your device, which also removes the data stored locally. Upon termination, you must stop using the App and delete all copies. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and governing law — survive.

11. Governing Law

This EULA is governed by the laws of the State of Iowa, United States, without regard to its conflict-of-law principles. You agree that any dispute not subject to the rules of the applicable app store will be resolved in the state or federal courts located in Iowa, to the extent permitted by law.
