1. Acceptance of Terms

By downloading, installing, or using Kelvin ("Kelvin," "the App"), provided by Adelyons Software LLC ("we," "us," or "our"), you agree to these Terms of Service and End User License Agreement (the "Terms") and to our Privacy Policy. If you do not agree, do not use the App.

2. Cold-Exposure Safety & Medical Disclaimer — Please Read

Kelvin is not medical advice and not a medical device. The App is a self-tracking and timing tool for cold exposure. It records, times, and helps you understand your own practice. It does not diagnose, treat, cure, or prevent any condition, and it does not provide a medical, clinical, or therapeutic program.

Cold exposure carries real and serious risks. These include, but are not limited to:

Cold shock — the involuntary gasp and rapid breathing on entry, which can lead to water inhalation and cardiac strain;
Afterdrop & hypothermia — continued cooling of your core after you exit the cold;
Shallow-water blackout / drowning — breath-holds in or near water can cause you to lose consciousness without warning. Never do breath-holds in or before water. The App's breathwork trainer includes a safety lock for this reason, but you remain responsible for your own conduct.

Consult a doctor first: Talk to a qualified physician before starting cold exposure, especially if you have a heart condition, high or low blood pressure, a circulatory or respiratory condition, are pregnant, or have any other medical concern.
Not a substitute for professional care: The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified professional.
No professional relationship: Using the App does not create a doctor-patient or other professional relationship between you and Adelyons Software LLC.
Guidance is informational: The cold-shock coach, exposure ramps, protocols, insights, and the on-device AI coach digest are informational aids generated from general guidance and the data you enter. They are non-diagnostic, may be incomplete or inaccurate, and must not be relied upon as medical advice.
Never plunge alone when in doubt, and never exceed your limits: Use common sense, have a way to exit and warm up, and stop immediately if you feel unwell. If you think you or someone else is in danger or having an emergency, contact your local emergency number (such as 911) immediately.
Assumption of risk: You voluntarily choose to engage in cold exposure and assume all associated risks. You are solely responsible for how you use the App and for your own safety.

3. License Grant

Subject to these Terms, Adelyons Software LLC grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on a device that you own or control, solely for your personal, non-commercial use. This license does not transfer any ownership rights. All rights not expressly granted are reserved.

4. The Service

Kelvin is a hardware-agnostic, local-first cold-exposure companion. It provides a plunge timer (breath-up, a plunge countdown with a first-30s cold-shock safety coach, and a guided warm-up), a session log with history, streaks and a calendar heatmap, a breathwork trainer with a near-water safety lock, free safety guardrails, a protocols library, and adaptation insights. It works with any cold source — ice bath, cold shower, lake, or tub — with no additional hardware. As described in our Privacy Policy, your data is stored only on your device; there is no account and no cloud backend. The optional Kelvin+ on-device AI coach digest may require a one-time, opt-in model download to your device.

5. Subscriptions & Billing (Kelvin+)

Free & Kelvin+: Kelvin's core — the plunge timer, the cold-shock safety coach and guardrails, and the session log — is free forever, and no payment card is required to explore the App. Kelvin+ adds optional insight and ambition features (adaptation insights, the on-device AI coach digest, custom protocols and a contrast/sauna builder, goals & challenges with shareable streak cards, and unlimited history with advanced stats). Plans currently include: a Monthly subscription at $3.99/month; an Annual subscription at $19.99/year (recommended); and a one-time Lifetime purchase at $39.99. All three unlock the same Kelvin+ features. Prices may vary by region and are shown in the App at the time of purchase.
Honest, store-managed billing: Subscriptions and the lifetime purchase are billed through your Apple App Store or Google Play account, using their in-app billing, and are managed through that account. We never see or store your payment-card details, and we never hold your subscription or your data hostage.
No dark-pattern trials: We do not use deceptive trials. The free tier is genuinely useful indefinitely so you can fully evaluate Kelvin before paying. If a free trial is ever offered, it will be clearly disclosed at the point of purchase and will be cancel-anytime.
Auto-renewal: The Monthly and Annual subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. The Lifetime option is a one-time, non-renewing purchase.
Cancellation: You can manage or cancel a subscription at any time in your device's subscription settings (Apple App Store or Google Play). Cancellation takes effect at the end of the current billing period.
Refunds: Refund requests are handled by Apple or Google according to their respective policies.
Changes: We may change pricing or the features included in Kelvin+ with notice; changes apply at your next renewal.

6. Your Content & Data

You own the sessions, notes, and other information you enter into the App. Because Kelvin is local-first, this content is stored only on your device; we do not receive, store, or claim any license to it. You are responsible for your own device backups (using the App's local export/restore) and for the accuracy of what you record. See the Privacy Policy for full details.

7. Acceptable Use

You agree not to:

Reverse-engineer, decompile, or tamper with the App, except to the extent permitted by law;
Use the App in any unlawful way or to infringe the rights of others;
Circumvent, disable, or interfere with the App's purchase or licensing mechanisms, or the breathwork safety lock;
Rely on the App for medical decisions, or use it in a way that ignores its safety guidance or your own physician's advice.

8. Intellectual Property

The App, its design, content, and software are owned by Adelyons Software LLC and are protected by intellectual property laws. These Terms grant you a personal, non-transferable, revocable license to use the App; they do not transfer any ownership rights.

9. Apple App Store — Additional Terms

If you download the App from the Apple App Store, the following additional terms apply, and you acknowledge and agree that:

These Terms are between you and Adelyons Software LLC only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
The license granted is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. To the extent these Terms conflict with Apple's standard Licensed Application End User License Agreement (EULA), the Apple Licensed Application EULA governs for App Store downloads.
Apple has no obligation to provide maintenance or support for the App. Any questions or support requests should be directed to us at dev@adelyons.com.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability, regulatory, or intellectual-property claims.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Disclaimers & No Warranty

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any timer, ramp, insight, digest, or report will be accurate or complete. See also the safety disclaimer in Section 2.

11. Limitation of Liability

To the maximum extent permitted by law, Adelyons Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, illness, loss of data, or loss of profits, arising from or related to your use of (or inability to use) the App or your participation in cold exposure, even if advised of the possibility of such damages. You acknowledge that cold exposure is an inherently risky activity that you undertake at your own risk. Our total liability for any claim related to the App shall not exceed the amount you paid us for the App in the twelve months preceding the claim.

12. Termination

You may stop using the App at any time by deleting it from your device, which also removes the data stored locally. We may suspend or terminate this license if you violate these Terms. These Terms continue to apply to your prior use.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Effective date" above and, where appropriate, through an in-app notice. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Iowa, United States, without regard to its conflict-of-law principles. You agree that any dispute not subject to the rules of the applicable app store will be resolved in the state or federal courts located in Iowa, to the extent permitted by law.
