Pitch & Swing Lab Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Pitch & Swing Lab mobile application (the "App"), provided by Adelyons Software LLC ("we," "our," or "us"), you agree to these Terms of Use. If you do not agree, do not use the App.

2. The Service

Pitch & Swing Lab analyzes short baseball and softball swing, pitching, and throwing clips that you record or import, and returns on-device estimates such as attack angle, swing path, estimated bat speed, arm slot, release, estimated arm speed, a 0–100 mechanics score, a pose-skeleton overlay, slow-motion replay, and a local training history.

Estimates, not measurements: All values are estimates produced by computer vision running on your device, and their accuracy depends on factors such as camera angle, lighting, frame rate, and distance. They are intended for entertainment, training feedback, and progress tracking — not for officiating, medical diagnosis, scouting or recruiting decisions, or any safety-critical use.

3. Eligibility

• The App is intended for general audiences and may be used by youth athletes with parent or coach supervision.
• If you are a minor, use the App only with the involvement of a parent, guardian, or coach who agrees to these Terms on your behalf.
• You are responsible for use of the App on your device, including any optional purchases made through your app store account.

4. Subscriptions & Payments

• Pitch & Swing Lab Pro: An optional upgrade that unlocks an unlimited training history, full slow-motion tools, and every analysis metric. The App is free to try with a limited number of saved analyses.
• Plans: Pro is offered as a monthly subscription, an annual subscription (which may include a free-trial introductory offer), and a one-time lifetime purchase. Exact prices are shown in the App at the time of purchase in your local currency.
• Billing: All purchases are billed by Apple (App Store) or Google (Play Store) under their respective terms.
• Free Trial: Where a trial is offered, it converts automatically to a paid subscription unless cancelled before the trial ends.
• Auto-Renewal: Subscriptions renew automatically until cancelled. Cancel anytime from your device's subscription settings. The lifetime option is a one-time, non-renewing purchase.
• Refunds: Refund requests are handled by Apple or Google according to their policies.

5. Your Content

You retain all ownership of the clips you record or import. Pitch & Swing Lab processes your clips locally on your device to compute your results; we do not receive, store, or claim any license to your footage. You are responsible for ensuring you have the right to record or import any clip you analyze, including the consent of any identifiable person in it.

6. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or tamper with the App, except to the extent permitted by law.
• Use the App in any unlawful way or to infringe the rights of others.
• Circumvent, disable, or interfere with the App's purchase or licensing mechanisms.
• Rely on the App's estimates for officiating, medical, scouting, or other consequential decisions.

7. Assumption of Risk

Baseball and softball activities — including hitting, pitching, throwing, and training drills — involve inherent risks of physical injury. You are solely responsible for your own safety and that of anyone you supervise. The App provides feedback only and is not a substitute for proper coaching, conditioning, warm-up, or medical advice.

8. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee the accuracy of any estimate and disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, Adelyons Software LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any personal injury, arising from your use of the App. Our total liability for any claim related to the App is limited to the amount you paid us for the App in the 12 months preceding the claim.

10. Termination

You may stop using the App at any time by deleting it from your device, which also removes the analyses and history stored locally. These Terms continue to apply to your prior use.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last Updated" date and, where appropriate, through an in-app notice. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Adelyons Software LLC is registered, without regard to conflict-of-law principles.
