1. Agreement to These Terms
These Terms of Use ("Terms") are a legal agreement between you and Adelyons Software LLC ("we," "our," or "us") governing your use of The Long Goodbye mobile application and related services (the "App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the App. The App is intended for adults in a relationship. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian.
3. Your Account & Pairing
- You sign in with Google or Apple. You are responsible for keeping access to that account secure.
- The App pairs exactly two people. Send an invite link only to a partner who consents to pair with you.
- You are responsible for the activity that happens under your account, including the taps, countdowns, and moments you send.
4. What The Long Goodbye Is
The App is a presence tool for long-distance couples — a home-screen widget, taps, reunion countdowns, and photo moments shared between two paired people. It is not a messaging, emergency, or location-tracking service, and presence (your partner's time of day) is based on time zone, not precise location. Do not rely on the App for urgent communication or safety-critical purposes.
5. Your Content
- You own your content. The photos and notes you send ("User Content") remain yours.
- License to operate the App. You grant us a limited, worldwide, royalty-free license to host, store, transmit, and display your User Content solely to deliver it to your paired partner and provide the App. This license ends when you delete the content or your account, except for copies in routine backups, which are purged on a rolling schedule.
- Responsibility. You are solely responsible for the content you send and confirm you have the right to share any photos you upload.
6. Acceptable Use & Objectionable Content
Even in a private two-person space, you agree not to use the App to create, send, or store content that:
- Is harassing, threatening, hateful, or abusive toward your partner or anyone else;
- Is sexually explicit involving a minor, or otherwise sexualizes a minor in any way;
- Is illegal, infringes someone else's rights, or violates their privacy;
- Is used to stalk, coerce, or control another person;
- Contains malware or attempts to disrupt or gain unauthorized access to the App.
If you ever feel unsafe, unpair immediately and contact your local authorities or a support service.
7. Subscriptions & Purchases (Together+)
- Free core. Pairing, time-zone presence, the basic widget, taps, one countdown, and limited photo moments are free.
- Together+ subscription. Together+ unlocks the premium widget pack, unlimited photo moments, multiple and recurring countdowns, and more for $5.99/month or $44.99/year, with a 7-day free trial on the annual plan. Prices are in USD and may vary by region and over time.
- Couple-shared unlock. Either partner's purchase unlocks Together+ for both of you. One subscription covers the couple, not each person.
- Billing. Purchases are billed to your Apple App Store or Google Play account. Subscriptions automatically renew at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Managing & canceling. Manage or cancel in your App Store or Google Play account settings. Deleting the App does not cancel a subscription. If you cancel, the couple retains Together+ until the end of the paid period.
- Refunds. Refunds are handled by Apple or Google under their policies; we generally cannot issue store refunds directly.
8. App Store Terms
You acquire the App through the Apple App Store or Google Play and your use is also subject to that store's terms. For iOS, the Apple Licensed Application End User License Agreement (EULA) applies; Apple and Google are not responsible for the App and are not parties to these Terms, but are third-party beneficiaries entitled to enforce them.
9. Intellectual Property
The App, including its software, design, and trademarks, is owned by Adelyons Software LLC and protected by law. We grant you a personal, non-transferable, non-exclusive, revocable license to use the App for its intended purpose. You may not copy, modify, reverse-engineer, resell, or create derivative works from the App except as permitted by law.
10. Termination
You may stop using the App, unpair, and delete your account at any time. We may suspend or terminate your access if you violate these Terms — in particular the acceptable-use rules in Section 6 — or to comply with the law or protect users. Upon termination, your right to use the App ends; sections that by their nature should survive (e.g., content ownership, disclaimers, and limitation of liability) will survive.
11. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that taps, moments, or notifications will always be delivered on time. Do not rely on the App for urgent or safety-critical communication.
12. Limitation of Liability
To the fullest extent permitted by law, Adelyons Software LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Governing Law & Changes
- Governing law: These Terms are governed by the laws of the United States and the State in which Adelyons Software LLC is organized, without regard to conflict-of-laws rules, except where your local consumer-protection law provides otherwise.
- Changes: We may update these Terms as the App evolves. Material changes will be communicated in-app or by updating the "Last Updated" date. Continued use after an update constitutes acceptance.
