1. Acceptance of Terms
By downloading, installing, or using the Axis mobile application ("Axis", "the App", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
Axis is operated by Adelyons Software LLC. These Terms constitute the End User License Agreement ("EULA") between you and Adelyons Software LLC.
2. Description of Service
Axis is a fitness tracking application that provides:
- AI-assisted body composition estimation from photographs
- Circumference measurement tracking with manual override
- Workout sync via the Hevy API
- AI-assisted nutrition estimation from food photos
- An AI coach for personalized fitness guidance
- Symmetry analysis and historical trend graphs
3. Subscription Terms
Axis offers a free tier with limited features and an "Axis Pro" auto-renewing subscription with the following plans:
- Axis Pro Monthly: $9.99 USD per month
- Axis Pro Annual: $59.99 USD per year
Auto-renewal disclosure:
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price.
- You can manage subscriptions and turn off auto-renewal in your device's App Store account settings.
- Any unused portion of a free trial period is forfeited when you purchase a subscription.
Prices may vary by region and are subject to change. You will be notified of any price increase before it takes effect, with the option to cancel.
4. Refunds
All subscription purchases are processed by Apple through the App Store. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. Adelyons Software LLC cannot issue refunds for App Store purchases.
5. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Axis on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and Conditions and Apple's Standard EULA.
6. User Responsibilities
You agree to:
- Provide accurate information when prompted (height, age, etc.) so AI estimates are meaningful.
- Not use Axis for any unlawful purpose or to circumvent any platform restrictions.
- Not reverse engineer, decompile, or attempt to extract the source code of the App.
- Not use Axis to harass, harm, or impersonate others.
- Maintain the confidentiality of any account credentials you connect (Hevy, etc.).
7. Health and Fitness Disclaimer
Axis is not a medical device. The App provides estimates only and is intended for general fitness and informational purposes. Body composition readings, calorie estimates, and AI coach advice are not medical advice.
Always consult a qualified healthcare professional before starting a new exercise program, changing your diet, or interpreting body composition data — especially if you have a medical condition, are pregnant, or are recovering from injury.
8. AI Accuracy Disclaimer
Axis uses machine learning to estimate body measurements, body fat percentage, calorie content, and other metrics from photographs and user-provided context. These estimates are inherently approximate. We make no guarantee of accuracy. You are responsible for verifying any value before relying on it for health, training, or nutritional decisions.
9. Third-Party Services
Axis integrates with the following third-party services. Your use of these features is also subject to their terms:
- Apple App Store: Subscription billing and refunds.
- Hevy: Workout sync (optional, user-initiated).
- Google Gemini: AI vision and language model inference.
- Supabase: Authentication and historical log storage.
- RevenueCat: Subscription state management.
10. Intellectual Property
Axis, including its design, branding, code, and content, is the property of Adelyons Software LLC and is protected by copyright and trademark law. You retain ownership of any photos you capture or data you input. By using the App, you grant us a limited license to process your data solely to provide the service to you.
11. Termination
You may stop using Axis at any time by deleting the App. We may suspend or terminate your access to the App if you violate these Terms. Termination does not entitle you to a refund of subscription fees already paid; cancellations take effect at the end of the current billing period.
12. Disclaimer of Warranties
Axis is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or accurate.
13. Limitation of Liability
To the maximum extent permitted by law, Adelyons Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid for the subscription in the 12 months preceding the claim.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the App or by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Travis County, Texas.
