1. Acceptance of Terms

By downloading, installing, or using Anchorly ("Anchorly," "the App"), provided by Adelyons Software LLC ("we," "us," or "our"), you agree to these Terms of Service and End User License Agreement (the "Terms") and to our Privacy Policy. If you do not agree, do not use the App.

2. A Companion, Not Medical Advice — Please Read

Anchorly is a supportive companion, not medical advice, not a diagnosis, and not a medical device. The App is a calm, dignified self-tracking and organization tool for caregivers. It helps you record and understand symptoms, behaviors, sundowning and agitation, medications, and good moments, and organize information for your own care circle. It does not diagnose, treat, cure, or prevent dementia, Alzheimer's, or any other condition, and it does not deliver any clinical or therapeutic program.

It organizes and reminds: Anchorly organizes and reminds; it does not provide medical, psychological, or care decisions. Always follow your care team's guidance, and seek professional help for medical concerns or emergencies.
Not a substitute for professional care: The App is not a substitute for professional medical, nursing, psychological, or social-care advice, diagnosis, or treatment. Always seek the advice of a qualified professional with any questions about your loved one's health or care.
No professional relationship: Using the App does not create a doctor-patient, clinician-patient, or other professional relationship between you and Adelyons Software LLC.
Patterns & insights are informational: Pattern insights, the sundowning curve, trigger rankings, the on-device AI weekly digest, and reports are informational aids generated from the data you enter. They are non-diagnostic, may be incomplete or inaccurate, and must not be relied upon for diagnosis, treatment, medication, or any clinical decision.
Medication reminders: The medication schedule and "given?" reminders are convenience tools only. They are not a guarantee that a dose was or should be taken; always follow the prescribing professional's and pharmacy's instructions.
Emergency disclaimer: Never disregard or delay seeking professional advice because of something in the App. If you think your loved one is in danger or having a medical emergency, contact your local emergency number (such as 911) immediately.
Use at your own discretion: You are responsible for how you use the App and any decisions you make, ideally in consultation with qualified professionals who know you and your loved one.

3. License Grant

Subject to these Terms, Adelyons Software LLC grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on a device that you own or control, solely for your personal, non-commercial use. This license does not transfer any ownership rights. All rights not expressly granted are reserved.

4. The Service

Anchorly is a local-first companion for the caregiver of someone living with dementia or Alzheimer's. It provides a fast daily log, a sundowning and agitation decoder that captures hard moments as Trigger → Behavior → What helped, a medication schedule with local "given?" reminders, a calm card and a person-centered life story, a daily caregiver check-in, pattern insights, and on-device report generation. As described in our Privacy Policy, your data is stored only on your device; there is no account and no cloud backend. The optional Anchorly+ on-device AI weekly digest may require a one-time, opt-in model download to your device.

5. Subscriptions & Billing (Anchorly+)

Free & Anchorly+: Anchorly's core daily log, decoder, life story, and caregiver check-in are free forever, and no payment card is required to explore the App. Anchorly+ adds optional insight and sharing features. Plans currently include: a Monthly subscription at $3.99/month; an Annual subscription at $19.99/year (recommended); and a one-time Lifetime purchase at $39.99. All three unlock the same Anchorly+ features. Prices may vary by region and are shown in the App at the time of purchase.
Honest, store-managed billing: Subscriptions and the lifetime purchase are billed through your Apple App Store or Google Play account, using their in-app billing, and are managed through that account. We never see or store your payment-card details, and we never hold your subscription or your data hostage.
No "free trial" bait: We do not use deceptive trials. The free tier is genuinely useful indefinitely so you can fully evaluate Anchorly before paying. If a free trial is ever offered, it will be clearly disclosed at the point of purchase and will be cancel-anytime.
Auto-renewal: The Monthly and Annual subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. The Lifetime option is a one-time, non-renewing purchase.
Cancellation: You can manage or cancel a subscription at any time in your device's subscription settings (Apple App Store or Google Play). Cancellation takes effect at the end of the current billing period.
Refunds: Refund requests are handled by Apple or Google according to their respective policies.
Changes: We may change pricing or the features included in Anchorly+ with notice; changes apply at your next renewal.

6. Your Content & Data

You own the information and notes you enter into the App, including everything you record about the person you care for. Because Anchorly is local-first, this content is stored only on your device; we do not receive, store, or claim any license to it. You are responsible for your own device backups (using the App's local export/restore) and for the accuracy of what you record. Where you record information about another person — your loved one, who may not be able to consent themselves — you are responsible for doing so appropriately, lawfully, and in keeping with their dignity and best interests, and for sharing any report you generate only with people who should see it. 7. Acceptable Use

You agree not to:

Reverse-engineer, decompile, or tamper with the App, except to the extent permitted by law;
Use the App in any unlawful way or to infringe the rights of others;
Circumvent, disable, or interfere with the App's purchase or licensing mechanisms;
Rely on the App for diagnosis, treatment, medication, or any clinical or care decision without consulting a qualified professional.

8. Intellectual Property

The App, its design, content, and software are owned by Adelyons Software LLC and are protected by intellectual property laws. These Terms grant you a personal, non-transferable, revocable license to use the App; they do not transfer any ownership rights.

9. Apple App Store — Additional Terms

If you download the App from the Apple App Store, the following additional terms apply, and you acknowledge and agree that:

These Terms are between you and Adelyons Software LLC only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
The license granted is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. To the extent these Terms conflict with Apple's standard Licensed Application End User License Agreement (EULA), the Apple Licensed Application EULA governs for App Store downloads.
Apple has no obligation to provide maintenance or support for the App. Any questions or support requests should be directed to us at dev@adelyons.com.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability, regulatory, or intellectual-property claims.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Disclaimers & No Warranty

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any pattern, insight, digest, reminder, or report will be accurate or complete. See also the disclaimer in Section 2.

11. Limitation of Liability

To the maximum extent permitted by law, Adelyons Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, loss of data, or loss of profits, arising from or related to your use of (or inability to use) the App, even if advised of the possibility of such damages. Our total liability for any claim related to the App shall not exceed the amount you paid us for the App in the twelve months preceding the claim.

12. Termination

You may stop using the App at any time by deleting it from your device, which also removes the data stored locally. We may suspend or terminate this license if you violate these Terms. These Terms continue to apply to your prior use.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Effective date" above and, where appropriate, through an in-app notice. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Iowa, United States, without regard to its conflict-of-law principles. You agree that any dispute not subject to the rules of the applicable app store will be resolved in the state or federal courts located in Iowa, to the extent permitted by law.
