1. Acceptance of Terms
By downloading, installing, or using the VibeInk mobile application ("VibeInk", "the App", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
VibeInk is operated by Adelyons Software LLC. These Terms constitute the End User License Agreement ("EULA") between you and Adelyons Software LLC.
2. Description of Service
VibeInk is an AI-powered tattoo design application that provides:
- AI-generated tattoo designs from text prompts and reference images
- Multi-spec design processing (original, stencil, and technical formats)
- AR Try-On: upload a photo to preview a tattoo on your body using AI inpainting
- A local design library for saving and managing your creations
3. Subscription Terms
VibeInk offers a free tier with limited monthly uses and a "VibeInk Pro" auto-renewing subscription for unlimited access.
VibeInk Pro — Auto-Renewing Subscription
- Price: As displayed in the App Store at the time of purchase.
- Billing period: Monthly or annually, as selected at checkout.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price.
- You can manage subscriptions and turn off auto-renewal in your device's App Store account settings after purchase.
- Any unused portion of a free trial period is forfeited when you purchase a subscription.
Prices may vary by region and are subject to change. You will be notified of any price increase before it takes effect.
4. Consumable Purchases
VibeInk also offers consumable in-app purchases (e.g., a 3-pack of additional design uses). These are one-time purchases that are consumed upon use and are not refundable once used.
5. Refunds
All purchases are processed by Apple through the App Store. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. Adelyons Software LLC cannot issue refunds for App Store purchases.
6. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use VibeInk on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and Conditions and Apple's Standard EULA.
7. User Responsibilities
You agree to:
- Use the App only for lawful purposes and not to generate content that violates applicable law or third-party rights.
- Not generate designs that are hateful, obscene, or that infringe on third-party intellectual property.
- Not reverse engineer, decompile, or attempt to extract the source code of the App.
- Not use automated means to abuse or circumvent usage limits.
8. AI-Generated Content
VibeInk uses AI services (including Google Gemini) to generate tattoo designs. By using these features:
- You grant us a limited license to process your text prompts and uploaded photos solely to provide the AI generation service to you.
- You are responsible for any content you generate and how you use it.
- AI-generated designs may be similar to other generated outputs; we do not guarantee uniqueness.
- We make no warranty that generated designs are free from intellectual property claims of third parties.
9. Third-Party Services
VibeInk integrates with the following third-party services:
- Apple App Store: Subscription billing and refunds.
- Google Gemini API: AI design generation and AR Try-On processing.
- Supabase: Authentication and backend services.
- RevenueCat: Subscription state management.
10. Intellectual Property
VibeInk, including its design, branding, and code, is the property of Adelyons Software LLC. You retain ownership of photos you upload. AI-generated designs created within the App are owned by you, subject to the license terms of the underlying AI service providers.
11. Termination
You may stop using VibeInk at any time by deleting the App. We may suspend or terminate your access if you violate these Terms. Cancellations take effect at the end of the current billing period; no partial-period refunds are issued.
12. Disclaimer of Warranties
VibeInk is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that AI outputs will be accurate, suitable for tattooing, or free from error.
13. Limitation of Liability
To the maximum extent permitted by law, Adelyons Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the App or by updating the "Last Updated" date above. Continued use of the App after changes constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of Texas, United States. Any dispute will be resolved in the state or federal courts located in Travis County, Texas.
