1. Acceptance of Terms
By downloading, installing, or using Upright: POTS & Dysautonomia Tracker ("Upright," "the App"), provided by Adelyons Software LLC ("we," "us," or "our"), you agree to these Terms of Service and End User License Agreement (the "Terms") and to our Privacy Policy. If you do not agree, do not use the App.
2. Medical Disclaimer — Please Read
Upright is not medical advice and not a medical device. The App provides general information and self-tracking tools to help you manage daily life with POTS and dysautonomia and to organize information for your own care team. It does not diagnose, treat, cure, or prevent any disease or condition.
- Not a substitute for professional care: The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions about a medical condition or before making changes to medication, salt or fluid intake, or activity.
- No doctor-patient relationship: Using the App does not create a doctor-patient or other professional relationship between you and Adelyons Software LLC.
- Standing test & data are informational: The guided standing heart-rate test, calculated heart-rate rise, intake targets, reminders, and reports are informational aids only. They are not diagnostic and may be affected by device sensors, technique, and other factors. Do not rely on them for diagnosis or treatment decisions.
- Emergency disclaimer: Never disregard or delay seeking professional medical advice because of something in the App. If you think you are having a medical emergency, call your doctor or your local emergency number (such as 911) immediately.
- Use at your own risk: You are responsible for how you use the App and any decisions you make, ideally in consultation with your healthcare provider.
3. License Grant
Subject to these Terms, Adelyons Software LLC grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on a device that you own or control, solely for your personal, non-commercial use. This license does not transfer any ownership rights. All rights not expressly granted are reserved.
4. The Service
Upright is a local-first app for managing daily life with POTS and dysautonomia. It provides a guided standing heart-rate (NASA lean) test, salt and fluid tracking toward daily targets, symptom and trigger logging, medication reminders, and on-device generation of a doctor-ready PDF report. As described in our Privacy Policy, your health data is stored only on your device; there is no account and no cloud backend.
5. Subscriptions & Billing (Upright Pro)
- Free & Pro: Upright's core tracking is free. Upright Pro unlocks the full experience. Plans currently include: an Annual subscription at $39.99/year with a 7-day free trial; a Monthly subscription at $6.99/month; and a one-time Lifetime purchase at $79.99. Prices may vary by region and are shown in the App at the time of purchase.
- Billing: Subscriptions and the lifetime purchase are billed through your Apple App Store or Google Play account, using their in-app billing, and are managed through that account. We never see or store your payment-card details.
- Free trial & conversion: Where a free trial is offered, it automatically converts to a paid subscription and your payment method is charged at the end of the trial period unless you cancel at least 24 hours before the trial ends.
- Auto-renewal: Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. The Lifetime option is a one-time, non-renewing purchase.
- Cancellation: You can manage or cancel a subscription at any time in your device's subscription settings (Apple App Store or Google Play). Cancellation takes effect at the end of the current billing period.
- Refunds: Refund requests are handled by Apple or Google according to their respective policies.
- Changes: We may change pricing or the features included in Pro with notice; changes apply at your next renewal.
6. Your Content & Data
You own the health information and notes you enter into the App. Because Upright is local-first, this content is stored only on your device; we do not receive, store, or claim any license to it. You are responsible for your own device backups and for the accuracy of what you record. See the Privacy Policy for full details.
7. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or tamper with the App, except to the extent permitted by law;
- Use the App in any unlawful way or to infringe the rights of others;
- Circumvent, disable, or interfere with the App's purchase or licensing mechanisms;
- Rely on the App for diagnosis, treatment, or any medical decision without consulting a qualified healthcare professional.
8. Intellectual Property
The App, its design, content, and software are owned by Adelyons Software LLC and are protected by intellectual property laws. These Terms grant you a personal, non-transferable, revocable license to use the App; they do not transfer any ownership rights.
9. Apple App Store — Additional Terms
If you download the App from the Apple App Store, the following additional terms apply, and you acknowledge and agree that:
- These Terms are between you and Adelyons Software LLC only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
- The license granted is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. To the extent these Terms conflict with Apple's standard Licensed Application End User License Agreement (EULA), the Apple Licensed Application EULA governs for App Store downloads.
- Apple has no obligation to provide maintenance or support for the App. Any questions or support requests should be directed to us at dev@adelyons.com.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability, regulatory, or intellectual-property claims.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
10. Disclaimers & No Warranty
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any reading, calculation, reminder, or report will be accurate or complete. See also the Medical Disclaimer in Section 2.
11. Limitation of Liability
To the maximum extent permitted by law, Adelyons Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, loss of data, or loss of profits, arising from or related to your use of (or inability to use) the App, even if advised of the possibility of such damages. Our total liability for any claim related to the App shall not exceed the amount you paid us for the App in the twelve months preceding the claim.
12. Termination
You may stop using the App at any time by deleting it from your device, which also removes the data stored locally. We may suspend or terminate this license if you violate these Terms. These Terms continue to apply to your prior use.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Effective date" above and, where appropriate, through an in-app notice. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Iowa, United States, without regard to its conflict-of-law principles. You agree that any dispute not subject to the rules of the applicable app store will be resolved in the state or federal courts located in Iowa, to the extent permitted by law.
