1. Agreement
This End User License Agreement ("EULA") is a legal agreement between you and Adelyons Software LLC ("we," "our," or "us") for the Bloom mobile application and any updates to it (the "App"). By installing or using the App you accept this EULA. It works alongside our Terms of Use and Privacy Policy; if this EULA and the Terms of Use conflict on the subject of the software licence, this EULA controls.
2. License Grant
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use one copy of the App on devices you own or control, for your own non-commercial use, in accordance with the usage rules of the store you obtained it from.
3. Restrictions
- Do not copy, sell, rent, sublicense, or redistribute the App.
- Do not reverse engineer, decompile, or disassemble the App, except where that right cannot lawfully be excluded.
- Do not remove or obscure any proprietary notices.
- Do not use the App to store or transmit unlawful, abusive, or harassing content, or to harass any contributor to a box.
4. Ownership & Intellectual Property
The App is licensed, not sold. We and our licensors retain all right, title, and interest in the App and its content. The notes, voice clips, and photos contributed to your box remain the property of the people who wrote them and of you as the box owner — we claim no ownership over them, and we do not use them to train any model.
5. Subscriptions & Billing (Summary)
Bloom's core is free. Bloom+ is an optional auto-renewing subscription; there are no one-time purchases. All prices are shown in your local currency by the App Store or Google Play at the time of purchase, and are charged to your store account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel them in your store account settings. Full details are in the Terms of Use.
6. Nature of the Service
Bloom is a private space for appreciation from people you invite. It is not a mental-health service and is not a substitute for professional care. If you are in crisis, contact your local emergency services or a crisis line. Bloom never generates messages on anyone's behalf — every note in your box was written by a real person in your circle.
7. Apple Licensed Application End User License Agreement
If you obtained the App from the Apple App Store, the following applies: this EULA is between you and Adelyons Software LLC only, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory non-compliance, or consumer-protection claims, or for the investigation, defence, settlement, or discharge of any third-party intellectual-property infringement claim. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, goodwill, or profits, arising out of your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or USD $50.
10. Termination
This licence continues until terminated. It ends automatically if you breach it, and you may end it at any time by deleting the App. You can delete your account and your box at any time from within the App or via our account deletion page. Sections 4, 8, 9, and 11 survive termination.
11. Governing Law
This EULA is governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules, except that this choice does not deprive you of the protection of mandatory consumer-protection laws of your country of residence.
