Bloom - Terms of Use

1. Agreement to These Terms

These Terms of Use ("Terms") are a legal agreement between you and Adelyons Software LLC ("we," "our," or "us") governing your use of the Bloom mobile application and related services (the "App"). By downloading, accessing, or using Bloom, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Bloom. If you are under the age of majority where you live, you may use Bloom only with the involvement of a parent or guardian.

3. Your Account

You sign in with Google, Apple, or Facebook. You are responsible for keeping access to that account secure.
You agree that the information you provide is accurate and that you will not impersonate anyone or create an account for someone else without authorization.
You are responsible for the activity that happens under your account.

4. What Bloom Is

Bloom is a private, invite-only space where the people you invite leave appreciations — text notes, voice clips, or photos. A box owner can read and keep the notes left for them. Bloom is intended for genuine encouragement and emotional well-being. It is not a medical, mental-health, or crisis service. If you are in crisis or may harm yourself or others, contact your local emergency number or a crisis line immediately.

5. User Content

You own your content. The notes, voice clips, and photos you create ("User Content") remain yours.
License to operate the App. You grant us a limited, worldwide, royalty-free license to host, store, transmit, and display your User Content solely to provide Bloom to you and the box members you share it with (for example, generating signed links so a box owner can view a note). This license ends when you delete the content or your account, except for copies in routine backups, which are purged on a rolling schedule.
Responsibility. You are solely responsible for the User Content you submit and confirm you have the right to share any photos, audio, or text you upload.

6. Acceptable Use & Zero Tolerance for Objectionable Content

Bloom exists to lift people up. There is zero tolerance for objectionable content or abusive behavior. You agree not to use Bloom to create, send, or store content that:

Is harassing, threatening, hateful, bullying, or intended to demean a person;
Is sexually explicit, obscene, or sexualizes a minor in any way;
Is violent, promotes self-harm, or encourages harm to others;
Is illegal, infringes someone else's rights, or violates their privacy;
Is spam, a scam, or impersonates another person;
Contains malware or attempts to disrupt or gain unauthorized access to the App.

                Moderation and our commitment to act. Bloom provides tools to report any note, to remove notes, and to block contributors. We review reports of objectionable content and abusive users and will remove offending content and eject the responsible user within 24 hours of a substantiated report. We may also use automated screening to detect slurs or threats before certain notes are delivered.

7. Subscriptions & Purchases (Bloom+ and Keepsake Book)

Free core. Bloom's emotional core — one box, text and photo notes, and the open/reserve loop — is free.
Bloom+ subscription. Bloom+ unlocks voice notes, unlimited media retention, themed boxes, and other features for $4.99/month or $39.99/year, with a 7-day free trial on the annual plan. Prices are in USD and may vary by region and over time.
Keepsake book. A printed, bound book of your notes is available as a one-time purchase, priced by page count (from $29.99).
Billing. Purchases are billed to your Apple App Store or Google Play account. Subscriptions automatically renew at the then-current price unless you cancel at least 24 hours before the end of the current period.
Managing & canceling. Manage or cancel your subscription in your App Store or Google Play account settings. Deleting the App does not cancel a subscription.
Refunds. Refunds are handled by Apple or Google under their policies; we generally cannot issue store refunds directly.

8. App Store Terms

You acquire Bloom through the Apple App Store or Google Play and your use is also subject to that store's terms. For iOS, the Apple Licensed Application End User License Agreement (EULA) applies; Apple and Google are not responsible for the App and are not parties to these Terms, but are third-party beneficiaries entitled to enforce them.

9. Intellectual Property

Bloom, including its software, design, and trademarks, is owned by Adelyons Software LLC and protected by law. We grant you a personal, non-transferable, non-exclusive, revocable license to use the App for its intended purpose. You may not copy, modify, reverse-engineer, resell, or create derivative works from the App except as permitted by law.

10. Termination

You may stop using Bloom and delete your account at any time. We may suspend or terminate your access if you violate these Terms — in particular the acceptable-use rules in Section 6 — or to comply with the law or protect users. Upon termination, your right to use the App ends; sections that by their nature should survive (e.g., content ownership, disclaimers, and limitation of liability) will survive.

11. Disclaimers

Bloom is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that notes will always be delivered or retained. Bloom is not a substitute for professional mental-health care.

12. Limitation of Liability

To the fullest extent permitted by law, Adelyons Software LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Governing Law & Changes

Governing law: These Terms are governed by the laws of the United States and the State in which Adelyons Software LLC is organized, without regard to conflict-of-laws rules, except where your local consumer-protection law provides otherwise.
Changes: We may update these Terms as Bloom evolves. Material changes will be communicated in-app or by updating the "Last Updated" date. Continued use after an update constitutes acceptance.
